Parkinson v Chief Constable of Dyfed Powys Police (2004)
Mr Parkinson was under the influence of alcohol when he was injured as he crossed the road into the path of a passing police car.
The car was travelling at 40 mph. The accident occurred late at night in a built up area.
The Court held the driver of the police car should have anticipated the prospect of pedestrians in a similar state to that of Mr Parkinson being in the area and as a result should have reduced his speed.
The police were found 65% liable and their appeal was refused.
